Terms of service

These terms are the agreement between your business and Mainly (The Trustee for the Knightley Trust, ABN 80 596 437 485, based in Queensland, Australia). By signing up for any of our services, you agree to them. We've written them in plain English. If anything's unclear, email hello@gomainly.com before you sign up.

1. Previews

We sometimes build a preview website for a business before it asks, using information that business has already made public. A preview is free. There's no obligation to buy, and nothing to cancel. Ask us at any time and we'll take a preview down.

2. What you get

Setup ($750, one-time). We finish your website, make the changes you ask for, and put it live on your web address once you've approved it.

Managed plan ($149/month). We keep your website online, secure and up to date; renew your web address; keep your Google Business Profile details current; and make small changes when you ask, up to one hour of work a month. Larger jobs we'll quote for first, and only do if you agree.

Growth plan ($299/month). Everything in Managed, plus review request texts to your customers, a monthly post on your Google Business Profile, help showing up in local search, and a short monthly report.

Own it outright ($2,990, one-time, no setup fee). We build your website, put it live, and hand over the files, with 30 days of help afterwards. Ongoing hosting and care aren't included.

Extras. Brand kit ($495) and printed business cards ($99 for 500), as described when you order them.

We aim to make most changes within 24 hours, often much sooner. That's a goal, not a guarantee.

3. Payment and billing

4. Minimum term and cancelling

5. Money-back on setup

If you're not happy with your setup, tell us within 30 days of paying and we'll refund your setup fee in full. If you do, your plan ends too, and nothing further is owed.

6. What's yours

7. Your part

8. Things outside our control

We work hard to keep your website online, but no one can promise 100% uptime. Our hosting, email and other providers can have outages, and we're not responsible for problems caused by them, by changes Google makes, or by events outside our reasonable control. We can't guarantee search rankings, reviews, calls or sales.

9. Limit of liability

As far as the law allows, our total liability to you for anything related to our services is limited to the amount you paid us in the 12 months before the problem arose. We're not liable for indirect losses, such as lost profits or lost business. Nothing in these terms limits liability that can't legally be limited.

10. Ending the service

We may end the service if you seriously or repeatedly break these terms, or if you don't pay. We'll give you written notice and a fair chance to fix the problem first, unless that isn't possible. If the service ends, section 6 still applies: your domain and content stay yours.

11. Changes to these terms

If we change these terms, we'll update the date at the top and email customers at least 30 days before the changes take effect. If you don't agree with a change, you can cancel before it takes effect without paying any remaining minimum term.

12. The legal bits

These terms are governed by the laws of Queensland, Australia. If there's a disagreement, we'll first try to sort it out by talking. If that doesn't work, it will be handled by the courts of Queensland, Australia. If any part of these terms can't be enforced, the rest still applies.
